Secrets AT THE CDC…..(That “Lefty” Federal Bureaucracy That’s NOT Supposed To Be Political)

WHAT DON’T THE BUREAUCRATS WANT YOU TO KNOW?

The Centers for Disease Control is a federal bureaucracy and, like all government agencies, is political. CDC employs scientists, but the idea that it is some sort of ivory tower representing “science” is ridiculous.

We are reminded of this fact by an article in the New York Times that Steve referred to briefly earlier today. The article is headlined, “The C.D.C. isn’t publishing large portions of the Covid data it collects.”

For more than a year, the Centers for Disease Control and Prevention has collected data on hospitalizations for Covid-19 in the United States and broken it down by age, race and vaccination status. But it has not made most of the information public.

Two full years into the pandemic, the agency leading the country’s response to the public health emergency has published only a tiny fraction of the data it has collected, several people familiar with the data said.

Much of the withheld information could help state and local health officials better target their efforts to bring the virus under control.

So why hasn’t CDC made public the large majority of the data it has collected, forcing “the outside experts whom federal health agencies look to for advice” to rely on Israeli data? CDC is, after all, a public agency, presumably working for all of us.

Kristen Nordlund, a spokeswoman for the C.D.C., said the agency has been slow to release the different streams of data “because basically, at the end of the day, it’s not yet ready for prime time.” She said the agency’s “priority when gathering any data is to ensure that it’s accurate and actionable.”

Another reason is fear that the information might be misinterpreted, Ms. Nordlund said.

We live in an age in which “misinformation” commonly means information that is inconvenient for the powers that be. Likewise, when CDC says it fears that its own data might be “misinterpreted,” it is reasonable to suspect that this means the data might reasonably be seen as contradicting CDC–i.e., Biden administration–narratives.

But now the case gets interesting, as the Times has updated the linked article twice, on Monday and Tuesday. The final version is considerably longer and is more forthcoming on what might possibly be prone to “misinterpretation.” It includes this paragraph:

The agency has been reluctant to make those figures public, the official said, because they might be misinterpreted as the vaccines being ineffective.

Ms. Nordlund confirmed that as one of the reasons.

We have just lived through a period of intense pressure on everyone, down to small children, to be vaccinated and boosted on the ground that only vaccination can save us all from covid disaster. Vaccine passports have been imposed in many locations, unvaccinated people have been treated as second-class citizens, and many liberals have argued that unvaccinated people should not be treated in hospitals if they become sick.

Now the CDC is telling us that, if you and I had access to all of their data, we likely would *misinterpret* it to indicate that the vaccines don’t work very well. (Independent analysts have already raised such questions based on other data sets.) Who knows, the CDC may also have data indicating that adverse side effects from vaccination are more common than the government has let on.

I don’t know about that, but I do know that I, and a great many others, are perfectly competent to analyze data without “misinterpreting” it. It seems obvious that in this case, “misinterpretation” means drawing conclusions that are unhelpful to the Biden administration, Anthony Fauci, and the Democratic Party. It is long past time for CDC to release the reams of data it has in its possession and let the rest of us argue about what conclusions we should draw from it.

This is a quaint idea: it presupposes a democracy in which bureaucrats actually work for the people who pay their salaries.

As I witness the madness of ‘King Joe the Fool,’ on my laptop under a big oak, I am laughing aloud. Am I going nuts? Of course not! I am in the woods, close to the sea, enjoying the advent of Spring…a Monet sky of soft blue and clusters of silvery white clouds, under the spectacular Sun and the gentle winds of the Gulf…I just cannot stop laughing at the bankrupt Democrats and their mumbling fool in the White House.

So let us thank the Lord, that in our still free land, the average person can cartoon the imbecilities of America’s haughty political class. Oh, yes; the Lord makes them foolish for the common folks, everywhere, to laugh aloud. I can only imagine how loud they are laughing at ‘King Joe the Fool’ in Moscow and Beijing.

U.S. V. TOU THAO (4) [UPDATED]

I went down to the Warren E. Burger Federal Building and U.S. Courthouse in downtown St. Paul to view the attorneys’ closing arguments in the federal trial of the three former Minneapolis police officers other than Derek Chauvin charged with violating the civil rights of George Floyd in the arrest that resulted in his death. The three officers are Tou Thao, Alexander Kueng and Thomas Lane. I covered the scene and the opening statements last month here.

The Associated Press covered the closing arguments in a story by Steve Karnowski, Tammy Webber and Amy Forliti here. I am not going to summarize the arguments in this post. Rather, I want only to add my own observations and impressions on the closing arguments in the form of bullet points.

• The video feed for reporters is in the Jury Assembly Room on the court’s first floor with windows overlooking Robert Street outside. The skyway into the courthouse is closed to the public and the building is ringed with special security fencing. Not a single protester has been in sight. I saw one St. Paul police officer stationed in a cruiser outside the First Bank Building kiddy corner and down the block from the courthouse on Robert Street. The situation was well in hand.

• Our winter weather has proved inimical to the mob scene that surrounded the trial of Derek Chauvin in Minneapolis. One of the reporters told me that protesters were organizing themselves on Facebook in anticipation of the jury, but they have made themselves scarce so far.

• The court declared a snow emergency and Judge Magnuson excused the jury at 4:00 p.m. without providing jury instructions. He is instructing the jury this morning.

• This case has disrupted and delayed the orderly prosecution of the three officers in state court. I have yet to see an explanation for what the Department of Justice has done here. In his closing argument, defense attorney Earl Gray raised the question in slightly different form and offered his own explanation. Gray indignantly exclaimed: “It’s politics!” (Judge Magnuson overruled the government’s objection.)

• Assistant United States Attorney Manda Sertich made the closing argument for the government. She emphasized the observations of the bystanders and the undisputed legal duties of the officers. Sertich read her opening statement from a notebook and drew on exhibits that illustrated her argument as she spoke. Her occasionally mocking tone grated on me. I thought Sertich’s argument was competent and effective but canned. Indeed, I thought she was most effective in thinking on her feet to modify her argument in response to the objections that Judge Magnuson sustained. KARE 11 reporter Lou Raguse thought more highly of her argument than I did (and I respect his judgment).

• Defense counsel objected frequently to Sertich’s argument. Judge Magnuson sustained a surprising number of these objections. He was antipathetic to the repetitive elements of the government’s case.

• Assistant United States Attorney LeeAnn Bell gave the rebuttal to the defense arguments and Judge Magnuson all but shut her down in response to defense objections. Bell was aggressive and skilled speaking from notes without a text. Her appearance and demeanor struck me as the essence of high-handed second-guessing from a perch in a comfortable office.

• Defense counsel Robert Paule represented Tou Thao and spoke on his behalf. I thought he was a credible and compelling advocate.

• Defense counsel Tom Plunkett represented Alexander Kueng. He was not good. He was the least persuasive of the three defense counsel — disorganized and somewhat incoherent.

• Defense counsel Earl Gray represented Thomas Lane and spoke on his behalf. Lane is charged with only one of the two counts the other officers face (the deliberate indifference count). The government’s case against Lane is the weakest of the three.

• Gray was intense in broad strokes that left openings on rebuttal. He was impassioned. He poured it on. Lane is a good man. He has lived a good life. Going beyond the presumption of innocence and the burden of proof, Gray did especially well in arguing that the evidence introduced against Lane was evidence of innocence.

• Each of the three officers testified at trial. All three defense counsel hammered on Floyd’s drug intoxication and the “excited delirium” that each of the officers believed Floyd labored with at the time of the arrest. It took three officers to subdue him and they were afraid that he would revive and continue his resistance. I would guess the jury will begin with Lane’s case in deliberations. He has a strong defense. If he is not acquitted, I should think the other officers will be convicted on both counts.

• None of the three defense attorneys mentioned in their closing that the government would have the last word before Judge Magnuson instructed them in the law they are to apply and that they would not have the opportunity to respond.

• All defense counsel emphasized the “willfulness” (“bad purpose” or “improper motive”) element of the two charges against Thao and Kueng. This is the challenge of the government’s case. Sertich and Bell asked jurors to use their common sense in analyzing this element. “Willfulness” is like a child doing what he knows is wrong.

• This was a much fairer trial than Chauvin’s. Chauvin defense counsel Eric Nelson confronted a dream team more or less all by himself. The presence of three defense counsel contending with the government in this case came closer to leveling the field. Perhaps most importantly, as I say above, each of the three officers testified in his own behalf and must have helped himself to some extent in the eyes of the jury.

UPDATE: Beyond the scope of anything I can contribute, Andrew McCarthy criticizes the Department of Justice’s theory of the case in his NRO column this morning (behind the NRO paywall):

[T]he Civil Rights Division is inflating what progressives see as best policing practices — e.g., that a police officer must take action to prevent another officer’s brutality (especially in a racially fraught case), and that a police officer must provide some minimum quantum of medical attention — as if those best-practice guidelines were actually constitutional rights. And DOJ is doing this in the absence of any congressional action. There is no law from which we could say that the Biden administration’s preferred practices have been codified into statutory rights. The prosecutors are simply making it up.

The Section 242 civil-rights crime prescribes the death penalty, life imprisonment, or a sentence of up to ten years, depending on the extent of bodily injury a victim suffers due to an alleged deprivation of rights. If penalties of such severity are going to be imposed, not just for violent police acts but for police omissions, then there must be a higher obligation on the Justice Department to spell out, in the indictment, exactly where it is stated in federal law that a police officer must take the action that prosecutors accuse him of omitting. Not in a Biden-preferred policing-practice manual; in an actual federal law. If there is no such federal-law provision, the Justice Department should be required to state, in the indictment, from what source it is deriving this duty to take action (is it a court decision, a presidential speech, a Justice Department memo?). Finally, to satisfy the criminal-intent requirement, prosecutors should also be required to state their basis for alleging that this duty is so well-established that the police officer’s failure to act must have been willful.

It is rudimentary constitutional law that an accused must be given notice of the crime charged. Cops have civil rights, too.

It’s a shame that no one has pressed the Department of Justice on any point related to this prosecution, let alone the question of fundamental right that Andy raises.

The Treason of the Ruling Class

Because of the egocentrism and megalomania of the current ruling class, our country is inexorably and stealthily marching toward a tyrannical one-party socialist oligarchy beholden to a globalist agenda.  These elites, in their determination to achieve political and societal status in perpetuity, are willingly allied with the relatively small number of true believers in their midst whose sole focus is to transform America into another failed socialist nation. 

In a major step toward accomplishing that goal, the ruling class in both Canada and the United States have calculatingly acquiesced to these ideologues maliciously exploiting the Covid-19 pandemic in order to permanently consolidate their political and societal status. 

The current and ongoing fascistic actions of the government in Canada in dealing with the trucker protest have revealed that this process is more advanced in Canada than it is the United States.  However, this nation is not far behind as its government has also declared a de facto war on America’s unwashed masses they claim are marinated in white supremacy and racism as these “deplorables” endlessly plot insurrections and domestic terrorism.

Fearful of the spread of a populist uprising, the true believers in Canada’s ruling class, as personified by Justin Trudeau, convinced the rest of their fellow ruling elites that they must violently stifle a peaceful grass roots political protest fomented by their deliberate abrogation of individual freedom.  They have brutally assaulted the demonstrators they refer to as domestic terrorists by invoking “emergency measures” designed for wartime.   This has allowed the government to unilaterally and without any legal basis freeze bank accounts and seize assets, censor non-state-sanctioned media, jail people without due process and outlaw any political demonstrations opposed to the regime. 

The true believers within the American ruling class, fearful of a populist uprising, convinced the rest of their alliance to go along with casting the January 6, 2021 protest as an “insurrection.” They have imprisoned many without bail or trial including those charged with misdemeanor trespassing.  They have choreographed public displays of arresting those who legally entered the Capitol and some who did not enter the building.  Their allies in the financial community have arbitrarily closed people’s bank accounts and businesses.  They have recruited the social media conglomerates to censor speech.  They have stereotyped of all who voted for Donald Trump as “domestic terrorists.”  

Never in the history of this country has there ever been a more mal-educated, narcissistic, gullible, and avaricious ruling class.  While unfortunately ignored by the bulk of the American citizenry for far too long, these traits were recognized and exploited by one of this nation’s most pernicious adversaries beginning five decades ago.

The Soviet Union did not intend to conquer but instead to destabilize the United State through societal and political transformation so that it would no longer be an impediment to their plans for global hegemony.  In the 1960’s and 70’s the KGB recognized that the quickest way to undermine the United States was through subverting those with elitist mindsets in the political, media, entertainment, education and corporate circles. 

The operational tenets of communism/socialism are particularly attractive to these egocentrics because these statist philosophies necessitate a permanent one-party ruling class and relegates the unwashed masses to de facto servitude.  Having to not answer to the “deplorable” citizenry and to wallow in one’s superiority is irresistible regardless of the reality of communism/socialism.  These elites are oblivious to the potential devastation to the bulk of society in becoming co-conspirators with the true believers in their midst.

As these destabilizing doctrines – the latest iterations focus on racial grievance and “equity” — inexorably penetrate into societal leadership groups, they become the basis on which controlled opposition is structured.  That is why the focus of the KGB was always on penetrating and influencing the elite power circles, as they recognized the egocentricity, gullibility and ignorance of so many among America’s ruling elites.

Yuri Bezmenov, a former KGB agent and defector from Russia explained these tactics in an interview in 1984 when he tried to alert America to what was happening as well as the long term consequences: 

Never bother with Leftists.  Forget about these political prostitutes.  Aim higher.  This was my instruction.  Try to get into large circulation established media, the rich, filthy rich movie makers, intellectuals, so-called academic circles, cynical egocentric people, who can look into your eyes with angelic expression and tell you a lie.  These are the most recruitable people, people who lack moral principles, who are either too greedy, or to suffer from self-importance, they feel that they matter a lot.

These are the people who KGB wanted to recruit.  Radicals serve only at the stage of destabilization of a nation.  For example, your leftists in the United States, all these professors and all these beautiful civil rights defenders, they are instrumental in the process of the subversion only to destabilize a nation.  When their job is completed, they are not needed any more.

The fact that the American ruling class was the primary target for the KGB speaks volumes about who they are and the accuracy of the Soviet strategy.  The Communist Chinese adopted these same tactics beginning in the 1990’s.  Their ongoing success in destabilizing the United States by effectively owning and manipulating many among the American elite class, including the current occupant of the White House, speaks for itself.

Perhaps the most apt description of this cabal was penned by the best political humorist since Will Rogers.  The late P.J. O’Rourke in his seminal work Give War a Chance wrote:

At the core of liberalism is the spoiled child — miserable, as all spoiled children are, unsatisfied, demanding, ill-disciplined, despotic and useless.  Liberalism is a philosophy of sniveling brats.

One can thus easily conjure up the image of Justin Trudeau, the entirety of the Biden Administration, Nancy Pelosi and her Congressional minions, Alexandria Ocasio-Cortez, Mark Zuckerberg and Bill Gates, the denizens of major corporate boardrooms, the professoriate at any major university, the “journalists” at the New York Times and the Washington Post and a litany of Hollywood actors and producers among a sea of duplicitous faces within the ruling class.

America, this is who is governing this country, this is who your leaders are. 

That is why it is no longer hyperbole to say what is happening in Canada can and in all probability will happen here unless a populist uprising turns on the major corporations, the legacy and social media, the dominant financial institutions, and the universities who are all dominated by the ruling elites.  And in November this same populist uprising must turn on all politicians, regardless of party affiliation, who are beholden to or are members of this cabal.

It appears the final steps in the transformation of Canada into a one-party socialist oligarchy beholden to a globalist agenda is well underway.  The warnings of so many have fallen on deaf ears in Canada; will they continue to do so here in the United States?

The operational tenets of communism/socialism are particularly attractive to these egocentrics because these statist philosophies necessitate a permanent one-party ruling class and relegates the unwashed masses to de facto servitude.  Having to not answer to the “deplorable” citizenry and to wallow in one’s superiority is irresistible regardless of the reality of communism/socialism.  These elites are oblivious to the potential devastation to the bulk of society in becoming co-conspirators with the true believers in their midst.

As these destabilizing doctrines – the latest iterations focus on racial grievance and “equity” — inexorably penetrate into societal leadership groups, they become the basis on which controlled opposition is structured.  That is why the focus of the KGB was always on penetrating and influencing the elite power circles, as they recognized the egocentricity, gullibility and ignorance of so many among America’s ruling elites.

Yuri Bezmenov, a former KGB agent and defector from Russia explained these tactics in an interview in 1984 when he tried to alert America to what was happening as well as the long term consequences: 

Never bother with Leftists.  Forget about these political prostitutes.  Aim higher.  This was my instruction.  Try to get into large circulation established media, the rich, filthy rich movie makers, intellectuals, so-called academic circles, cynical egocentric people, who can look into your eyes with angelic expression and tell you a lie.  These are the most recruitable people, people who lack moral principles, who are either too greedy, or to suffer from self-importance, they feel that they matter a lot.

These are the people who KGB wanted to recruit.  Radicals serve only at the stage of destabilization of a nation.  For example, your leftists in the United States, all these professors and all these beautiful civil rights defenders, they are instrumental in the process of the subversion only to destabilize a nation.  When their job is completed, they are not needed any more.

The fact that the American ruling class was the primary target for the KGB speaks volumes about who they are and the accuracy of the Soviet strategy.  The Communist Chinese adopted these same tactics beginning in the 1990’s.  Their ongoing success in destabilizing the United States by effectively owning and manipulating many among the American elite class, including the current occupant of the White House, speaks for itself.

Perhaps the most apt description of this cabal was penned by the best political humorist since Will Rogers.  The late P.J. O’Rourke in his seminal work Give War a Chance wrote:

At the core of liberalism is the spoiled child — miserable, as all spoiled children are, unsatisfied, demanding, ill-disciplined, despotic and useless.  Liberalism is a philosophy of sniveling brats.

One can thus easily conjure up the image of Justin Trudeau, the entirety of the Biden Administration, Nancy Pelosi and her Congressional minions, Alexandria Ocasio-Cortez, Mark Zuckerberg and Bill Gates, the denizens of major corporate boardrooms, the professoriate at any major university, the “journalists” at the New York Times and the Washington Post and a litany of Hollywood actors and producers among a sea of duplicitous faces within the ruling class.

America, this is who is governing this country, this is who your leaders are. 

That is why it is no longer hyperbole to say what is happening in Canada can and in all probability will happen here unless a populist uprising turns on the major corporations, the legacy and social media, the dominant financial institutions, and the universities who are all dominated by the ruling elites.  And in November this same populist uprising must turn on all politicians, regardless of party affiliation, who are beholden to or are members of this cabal.

It appears the final steps in the transformation of Canada into a one-party socialist oligarchy beholden to a globalist agenda is well underway.  The warnings of so many have fallen on deaf ears in Canada; will they continue to do so here in the United States?

U.S. Capitol Police close D.C. streets ahead of the “People’s Convoy”, fencing goes back up at Capitol

American truckers and their supporters are organizing and heading to Washington, D.C. to protest COVID-19 mandates. The People’s Convoy is patterned after Canada’s Freedom Convoy. Truckers will leave California tomorrow and arrive in Washington on Saturday, March 5. D.C. law enforcement is preparing for their arrival.

The People’s Convoy announced plans to launch a “peaceful and unified transcontinental movement” in Southern California. Organizers say their intention is to have a “law-abiding convoy” with truckers, blue-collar workers and supporters participating in it. According to the news release, they expect supporters from all walks of life. Their news release named some conservative-leaning journalists who will join the convoy to cover the event, providing daily updates as they travel across the country.

American truckers are launching The People’s Convoy, a peaceful and unified transcontinental movement, on Wednesday, February 23, 2022, from the Adelanto Stadium in Southern California. Starting at 10:00 a.m., hundreds of truckers will hear words of encouragement and blessings from a group of speakers including FLCCC President Dr. Pierre Kory and Godspeak Church Pastor Rob McCoy. The truckers and blue-collar workers of the United States will be joined by freedom-loving supporters from all walks of life – frontline doctors, lawyers, first responders, former military servicemen and women, students, retirees, mothers, fathers and children – on this peaceful and law-abiding transcontinental journey toward the east coast. The truckers encourage one and all to come out to the stadium in the heart of Adelanto, California to wish them well, see them off and join in the journey.

This convoy is about freedom and unity: the truckers are riding unified across party and state lines and with people of all colors and creeds – Christians, Muslims, Sikhs, Mormons, Agnostics, Blacks, Hispanics, Asians, Native Americans, Republican, Democrats. All individuals are welcome to participate by either attending the launch gathering – at 10:00 a.m. on Wednesday February 23, at Adelanto Stadium – or by getting in their own vehicles and following the big rigs from Adelanto toward the east coast!

The message of The People’s Convoy is simple. The last 23 months of the COVID-19 pandemic have been a rough road for all Americans to travel: spiritually, emotionally, physically, and – not least – financially. With the advent of the vaccine and workable therapeutic agents, along with the hard work of so many sectors that contributed to declining COVID-19 cases and severity of illness, it is now time to re-open the country. The average American worker needs to be able to end-run the economic hardships of the last two years, and get back to the business of making bread – so they can pay their rents and mortgages and help jumpstart this economy. D.C. law enforcement agencies are preparing and a request for assistance from the National Guard has been made. U.S. Capitol Police (USCP) released a statement that they are aware of the convoy’s plans and are on alert. The D.C. National Guard, if activated, will test its new activation process put in place after the January 6 riot on Capitol Hill.

“The District of Columbia National Guard is aware of a request for assistance sent to the Department of Defense by the District of Columbia Homeland Security and Emergency Management Agency,” Maj. Aaron Thacker, a spokesman for the DCNG, said in a statement to Military Times.

The request, he said, “asks DCNG provide traffic control support to the District of Columbia Metropolitan Police Department in anticipation of First Amendment demonstrations expected next week in the District. DCNG is also aware of a similar request for assistance submitted by the U.S. Capitol Police.”

Pending DoD approval, DCNG “stands ready to provide support to the citizens of the District as directed by the secretary of defense.” If approved, this would be one of the first uses of a new, more-streamlined DCNG activation process established in the wake of the Jan. 6. 2021 attack on the U.S. Capitol.

USCP has already closed off some streets in preparation for the convoy’s arrival and any traffic congestion caused by the trucks.

The USCP put out a statement that it is “closely coordinating with local, state, and federal law enforcement agencies, including DC’s Metropolitan Police Department, the United States Park Police, the United States Secret Service and other allied agencies to include the DC National Guard.” That is something that wasn’t done despite the warning USCP received about a potential protest on Capitol Hill on January 6, which turned violent. There is no indication that there will be any such problems on March 5. The latest update from USCP includes the decision to put up temporary fencing around the Capitol as extra security before the joint session of Congress for the State of the Union address on March 1. The fencing is expected to go up next week.

The convoy comes at a time that many states and cities are easing COVID-19 mandates, some beginning to do away with all restrictions. This isn’t February 2021. The pandemic is entering the endemic stage. In other words, it’s time that everyone learns to live with the virus because it isn’t going away. The mask mandates, for example, have been discredited as protection from COVID unless N-95 masks are used and are properly fitted. The cloth masks may make the wearer feel better but they don’t do the job. Vaccination requirements by employers are ending. Biden continues to lose court cases filed against his authoritarian mandates. The truckers are rallying to push the administration into moving more quickly in ending what is left of the mandates.

…belongs to Alexander Vindman. He is the former National Security Council staffer who played a role in the first Trump impeachment charade, and since then has made a modest television career bashing Republicans. Think of him as the Michael Avenatti of the national security establishment.

Yesterday, as a guest on the Rachel Maddow show, Vindman tried to blame Russia’s Ukraine incursion on conservative pundits in the U.S.:

Guest host Ali Velshi asked, “Are you a little bit puzzled at the responses coming from some right-wing American media, and now members of the Republican Party that seem to be implying that maybe this isn’t all that bad. There may not be a clear reason why we should be wary of a Russian invasion of Ukraine.”

Vindman said, “I think these folks, these right-wing pundits, the head of the GOP that is supportive of it really frankly have blood on their hands because they’re encouraging and enticing this kind of opportunism from Putin. It’s not just plain rhetoric that you can say something without consequences like too often happens in the United States. This has real consequences. People are going to die because of this.”

I don’t know of anyone on the right who has “supported” or “encouraged” Putin’s Ukraine adventurism. I think opinion on the right is divided between those who take a hawkish view and stress the importance of blunting Russian ambitions in Eastern Europe, and those who emphasize the reality that we aren’t going to war over Ukraine; certainly not over the eastern regions that Putin has so far “recognized.” And if some think that what Russia has done so far “isn’t all that bad,” it may be because “the [breakaway areas were] already controlled by Russian-backed separatists and Moscow in practice.”

In any event, Vindman’s suggestion that Vladimir Putin takes his foreign policy cues from conservative pundits in the U.S., when our President is a Democrat and the entire Executive Branch is staffed by Democrats, is risible. The only takeaway here is that there is no depth to which MSNBC will not sink.

Earlier today I credited Alexander Vindman with the hottest take on Ukraine. Vindman blamed Russia’s aggression on conservative pundits in the United States. Because we have so much influence on the Biden administration, apparently.

But yesterday my old law professor Larry Tribe went Vindman one better with this bizarre tweet. Which, by the way, was published at 4:09 a.m., not generally seen as a time for clear, sober thinking:

Tribe thinks that Tucker Carlson and other unnamed Republicans in the “Trump wing” of the party are guilty of treason, and therefore subject to criminal prosecution and five years’ imprisonment under 18 U.S.C. § 2381. This is sheer lunacy, as the question at hand is whether the U.S. should support one side or the other in a foreign controversy, and if so, at what level, given that actual ground warfare is not on the table. There is no conceivable basis on which taking any position on such a question constitutes treason; otherwise there would be a far more substantial case that many Democrats who opposed the Vietnam War or the first and second Gulf Wars should be in prison.

I almost never watch television news, so I don’t know exactly what Tucker Carlson has been saying about Ukraine. I take it that he is a dove–as most Democrats have been in most foreign policy controversies–and thinks that the U.S. has little or no interest in the Russia-Ukraine conflict, that Russia’s case is not notably weaker than Ukraine’s, and that we should stay out of it. Whether you agree with that view or not, only a lunatic would say that it is treasonous.

As for the rest of the “Trump wing” of the Republican Party, is there any validity to Tribe’s claim that it is “throwing its weight behind Putin”? Trump himself has denounced Joe Biden for imposing only “weak” sanctions on Russia:

Russia has become very very rich during the Biden Administration, with oil prices doubling and soon to be tripling and quadrupling. The weak sanctions are insignificant relative to taking over a country and a massive piece of strategically located land….

Trump says–correctly, it seems–that “[Putin] would have never done during the Trump administration what he is doing now, no way!” It is hard to understand how this constitutes “throwing [Trump’s] weight behind Putin.”

How about the rest of the “Trump wing” of the Republican Party? The place to start, presumably, is with Trump’s Secretary of State, Mike Pompeo. Has Pompeo been “throwing [his] weight behind Putin”? It doesn’t seem so. Pompeo says that “we should be crushing the Russians on this.”

How about other relevant Republicans? Idaho Senator Jim Risch is the ranking Republican on the Senate Foreign Relations Committee. He said:

This is precisely the kind of action that many of us expected, and it is one step closer to Putin’s clear goal of dismantling Ukraine’s sovereignty. The U.S. and our allies must immediately implement harsh sanctions that Putin cannot ignore.

Not exactly “throwing his weight behind Putin.” Senator Tom Cotton was often identified with President Trump’s foreign policies. Has he “thrown his weight behind Putin”? This is what he had to say:

President Biden’s timid sanctions tonight are wholly unequal to this moment. Russia is invading Ukraine now. The time has come for the “swift and severe” sanctions that Joe Biden has long threatened but refused to impose. There is not a minute to lose.

How pro-Russia can you get? Obviously, apart from the idea that disagreeing with a Democratic President constitutes treason–which I think is perilously close to the view held by many Democrats, like Larry Tribe–this is, in a sane world, anti-Russian.

Ted Cruz is a prominent Republican Senator who generally sided with President Trump on foreign affairs. What does he have to say?

[The] United States must impose devastating sanctions against Putin’s interests, including immediate and mandatory sanctions permanently putting an end to his Nord Stream 2 pipeline.

Larry Tribe’s suggestion that the “Trump wing” of the Republican Party is somehow pro-Putin is literally demented. It makes me sad that Tribe, whom I considered a friend and a normal and reasonable person when I knew him decades ago, has fallen so far.

For present purposes, though, what is sadder is that, as of the time of the screen shot embedded above, Tribe’s tweet had 4,998 retweets, 637 quote tweets, and 18,300 likes. There are a great many Democrats to whom even the most insane anti-Republican screed makes perfect sense. If they had their way, we would all be either unemployed or in prison.
