Our Constitutional Crisis Has to Do with Democrats Corrupting America’s Intelligence, Decency, and Freedom

OUR CONSTITUTIONAL CRISIS HAS NOTHING TO DO WITH JAMES COMEY

“President Trump’s firing of FBI director James Comey has been pretty big news, and there will be no dearth of continued commentary about what it means.  But what rings hollowest in all the commentary surrounding it have been the nearly uniform claims among the left that his firing represents a “constitutional crisis.”

Does the left now care about the United States Constitution?  Because that would certainly be newsworthy.  This is the same left which, as David Harsanyi of The Federalist reminds us, didn’t utter a peep of disapproval about President Obama’s efforts to “unilaterally legalize millions of people without Congress.”  What about the constitutionality of the federal government forcing people to purchase health insurance, forcing private health insurance companies to cap prices for higher-risk clients, setting school lunch menus, peculiarly targeting conservative groups for tax audits, or executive directives to ignore federal immigration law?  The left didn’t care about “constitutionality” when all of those things happened during Obama’s presidency, but now are shouting from the pulpit that Donald Trump’s firing of the current FBI director, whose direct role is to “serve at the pleasure of the president,” is somehow some incredible affront to the liberty guaranteed by the Constitution?

The left’s hypocrisy here is certainly stark, but in a way, it is evidence that the term “constitutional crisis” has been thrown around in so many pithy accusations over the years by the left and right that the phrase no longer has any meaning relative to the actual Constitution of the United States.

Consider that Princeton political scientist Keith Whittington suggests that “[c]onstitutional crises arise out of the failure, or strong risk of failure, of a constitution to perform its central functions.”

The “central function” of our Constitution has always been to limit the authority of the federal government, and to clearly enumerate the “few and defined” powers of the federal government to be held in contrast to the “numerous and indefinite” power of state governments, as James Madison wrote in Federalist No. 45.

Yet today, a great many of the things that we consider to be within the federal government’s purview are absolute affronts to the Constitution, and particularly the Tenth Amendment, which Thomas Jefferson held to be the foundation of the Constitution:

I consider the foundation of the Constitution as laid on this ground: “That all powers not delegated to the United States, by the Constitution, nor prohibited to it by the States, are reserved to the States and the People.”  To take a single step beyond the boundaries thus specifically drawn around Congress is to take possession of a boundless field of power, no longer susceptible of any definition.

How can we define our nation to be one of limited federal authority when, every day, we see that the restrictions of our Constitution have become meaningless? And if the limitations of the Constitution (again, its central function) have largely become meaningless, how can it be denied that we have long existed in a state of “constitutional crisis?”

A federal Department of Education (DoE), for example, has absolutely no right to exist in the scope of the Constitution.  Congress was beyond its tether when it allowed for this executive institution to have been born.  Yet billions upon billions of taxpayer dollars have been thrust into this federal institution to regulate our children’s education, and few ever consider the question as to whether there was the right, in the first place, of the federal government to create such an institution with the immeasurable power it has.

Tell me, where in the Constitution can you find any evidence that the federal government has the right to confiscate wealth from Americans, and then to grant or withhold payment to states based upon this federal agency’s evaluation of their adequate adoption of Common Core curricula?  And when you cannot find any such evidence that the federal government has such a right granted by the Constitution, wouldn’t you have to admit that the Obama administration’s having done precisely that is in direct violation of the Tenth Amendment, and thus represents a “constitutional crisis?”

Take a look at the Department of Labor, the Environmental Protection Agency, the Federal Communications Commission, or the Department of Transportation.  There is equally no allowance given to the federal government, by the Constitution, to regulate these spheres of assumed jurisdiction.  All of these agencies, including the DoE, more embody the planks of Communism found in Marx’s Manifesto than our own Constitution.  And yet the mere fact that these federal now agencies exist is enough to give us, with our modern sensibilities, the presupposition that the federal government must have a right to exert its influence in said areas of life, however cumbersome or costly they may be, and however absent any validation for that assumed power might be in our nation’s Constitution.

The reality is that very little of anything Washington considers its day-to-day business today has anything to do with the Constitution.  Our constitutional crisis is, and for quite some time has been, that the Constitution no longer matters in our political discourse.  Our national conversation about whether a thing is right or wrong tends to be a matter of preference and partisan interest.  Yes, the Constitution can be opportunistically invoked by either side as substantiation for any outrage. But it is generally an argumentative substrate of convenience, and rarely of principle.

The left is currently demonstrating this with the furor over Comey’s firing, but I sincerely hope that when conservatives talk about “draining the swamp” in D.C., they are suggesting a return to constitutional principles of limited federal authority, because this thing works both ways.

After all, if Ivanka Trump pushes for a $500 billion federal childcare bill (as she’s doing) because it’s her preferred cause du jour, and Congress indeed acts to provide single mothers with taxpayer dollars for childcare, wouldn’t it be very much like the federal overreach that we once claimed Obamacare represented, and thus be a true “constitutional crisis?”  Where does the Constitution define that the role of the federal government to seize wealth from taxpayers to provide childcare for American mothers?

If you happen to like this idea so much, you are free to petition your state to enact such a law with your state’s money to subsidize the payments.  I believe it would still be wrong, but this is how federalism works, and how the Constitution was intended to work.

We can only make American great again by again making America what the Constitution intended it to be.  And we can only do that by working to rein the federal government back within the boundaries that the Constitution defines.”

The inmates are running the asylum — and not with any of the humor of One Flew Over the Cuckoo’s Nest.  It’s only a slight exaggeration to say that Social Justice Warriors are to social justice what the Democratic People’s Republic of North Korea is to democracy.  In a few years, freshman handbooks may no longer be necessary.  They can give out copies of Orwell’s Animal Farm instead.

And I’m not just talking about recent events at UC Berkeley, where the onetime bastion of the free speech movement has turned into ground zero for the anti-speech movement, spearheaded by the violent masked goons of the absurdly named “antifa,” speaking of Orwellian constructs. Berkeley’s administrators agree. In canceling Coulter’s speech next week, they made no bones about the fact that there are now so many fascist “anti-fascist” animals running around campus that Coulter herself or someone in the audience literally might not leave it alive. And after what happened when Milo Yiannopoulos tried to speak in February, that’s a perfectly reasonable fear. You call the local police in Berkeley if you want to arrange “symbolic arrests” at the sit-in you’re organizing for your pet cause, not to stop rampaging leftists bent on smashing store windows and skulls because a thoughtcriminal has arrived in town.

She says she’s going to show up anyway. Who’ll secure the speech to make sure that the “heckler’s veto” doesn’t silence her? The mayor? Jerry Brown? Trump?

UC Berkeley officials say they were “unable to find a safe and suitable” venue for the right-wing provocateur who was invited to speak by campus Republicans on April 27.

In a letter to Berkeley College Republicans sent Tuesday, Vice Chancellor Scott Biddy said officials made the decision in consultation with campus police who determined they could not ensure the safety of Coulter, audience members or protesters expected at the event…

University spokesman Dan Mogulof said that posters went up on campus last week threatening disruption of the event and officials discovered “targeted threats” on various websites indicating the possibility of planned violence.

We’ve reached the point now in American academic culture where the risk of “active security threats” needs to be weighed when scheduling someone to come to your campus to talk immigration. According to Coulter, the university tried to get her to back out of the speech “voluntarily” by imposing some demands on her — the speech had to be held in the afternoon (since rioters are more likely to come out at night), only students would be allowed to attend (to make sure local agitators can’t get in), and the venue wouldn’t be announced until the last minute (presumably so that “protesters” couldn’t shut down the building before Coulter showed up). Her sponsor, the Young America’s Foundation, advised her not to agree. But she did agree, on the condition that Berkeley met two demands of her own:

1) That the University of California chancellor request that the Oakland chief of police refrain from telling his men to stand down and ignore law-breaking by rioters attempting to shut down conservative speakers, as he has done in the past; and

2) That UC-Berkeley announce in advance that any students engaging in violence, mayhem or heckling to prevent an invited speaker from speaking would be expelled……..”  There’s more below:

“Where are the faculty? American college students are increasingly resorting to brute force, and sometimes criminal violence, to shut down ideas they don’t like. Yet when such travesties occur, the faculty are, with few exceptions, missing in action, though they have themselves been given the extraordinary privilege of tenure to protect their own liberty of thought and speech. It is time for them to take their heads out of the sand.

I was the target of such silencing tactics two days in a row last week, the more serious incident at Claremont McKenna College in Claremont, California, and a less virulent one at UCLA.

The Rose Institute for State and Local Government at Claremont McKenna had invited me to meet with students and to give a talk about my book, The War on Cops, on April 6. Several calls went out on Facebook to “shut down” this “notorious white supremacist fascist Heather Mac Donald.” A Facebook post from “we, students of color at the Claremont Colleges” announced grandiosely that “as a community, we CANNOT and WILL NOT allow fascism to have a platform. We stand against all forms of oppression and we refuse to have Mac Donald speak.” A Facebook event titled “Shut Down Anti-Black Fascist Heather Mac Donald” and hosted by “Shut Down Anti-Black Fascists” encouraged students to protest the event because Mac Donald “condemns [the] Black Lives Matter movement,” “supports racist police officers,” and “supports increasing fascist ‘law and order.’” (My supposed fascism consists in trying to give voice to the thousands of law-abiding minority residents of high-crime areas who support the police and are desperate for more law-enforcement protection.)…….”   Please continue reading below:

Six-Week University Program Will ‘Help’ Men Not Act Like Men

“The University of Wisconsin-Madison is starting its six-week “Men’s Project,” a program designed to brainwash young men to not act like men because men are awful:

“The program operates on a transformative model of social justice allyship,” explains a news release from UW-Madison. “First, facilitators ask students to consider how the students’ opinions about masculinity affect their own perceptions every day. Second, they consider how those opinions affect the people around them.”

One goal of the project, said Sam Johnson, a violence prevention specialist at the University Health Services, is to “prevent future violence” by analyzing “unhealthy interactions” caused by traditional perceptions of masculinity and their role in gender-based violence, alcohol, and relationships.

The Men’s Project, which is in its second year of operation, begins with a weekend retreat and then continues with six weekly meetings lasting two hours each.

According to past participants of the program, the Project helped them become more vulnerable and make masculinity a “choice” rather than the default option.

LGBT Rules of Language to be Forced on Churches in Massachusetts

Massachusetts Forces LGBT ‘Accommodation’ Rules on Churches

“On October 1, 2016, the nation’s strictest LGBT non-discrimination laws will come into effect in Massachusetts. According to the “Gender Identity Guidance” released by the Massachusetts Commission Against Discrimination (MCAD) last week, even churches must refer to transgender individuals by their chosen “gender identity,” ignoring their biological sex. This effectively means churches must acknowledge transgender ideology or practice their doctrine on human sexuality in secret — putting Christianity in the closet.

The guidance specifically mentions churches as falling under the “public accommodation” restrictions against “discrimination” on the basis of gender identity: “Even a church could be seen as a place of public accommodation if it holds a secular event, such as a spaghetti supper, that is open to the general public,” the MCAD explained.

The restrictions are massive. Any “public accommodation” must allow patrons to use men’s or women’s restrooms — and locker rooms and changing rooms— “consistent with their gender identity.” Such places must also “use names, pronouns, and gender-related terms appropriate to employee’s stated gender identity in communications with employee and with others.”
